When a Bakersfield Workplace Injury Has a Personal Injury Angle
Not every injury on a Kern County worksite is limited to a workers’ compensation claim. When a party other than your employer, such as a subcontractor, equipment manufacturer, or property owner, contributed to the injury, a third-party personal injury claim may be available alongside your workers’ comp benefits. Third-party claims can recover damages that workers’ compensation doesn’t cover, including pain and suffering and lost wages not available through workers’ compensation.
This distinction matters most in Bakersfield’s dominant industries. Oilfield worksites often involve multiple contractors operating on the same property. Agricultural operations rely on equipment from outside vendors. Industrial facilities may be owned by entities separate from the employer. In each of these settings, a third party’s negligence can create liability beyond the workers’ compensation system.
Ghitterman, Ghitterman & Feld has represented clients across Bakersfield’s agriculture, oilfield, industrial, and trucking sectors since 1956. Because we handle both workers’ compensation and personal injury claims within the same firm, we can identify when an injury supports a third-party lawsuit and pursue both tracks without requiring clients to coordinate separate legal teams.
For clients whose pre-existing conditions were worsened by a work-related injury, we also evaluate eligibility for Subsequent Injuries Benefits Trust Fund (SIBTF) benefits. Under California law, SIBTF benefits are available when a work injury combined with a prior disability produces a greater overall level of disability than either condition would cause alone. Identifying this option early and pursuing it alongside a personal injury or workers’ compensation claim can significantly affect the total compensation available to an injured worker in Kern County.
