Workers’ Compensation Benefits After a California Industrial Accident
California’s workers’ compensation system is a no-fault program, meaning your benefits aren’t contingent on proving your employer caused the accident. Workers’ compensation is the starting point, not the ceiling. We explore every available compensation path for each client, including whether additional claims can meaningfully increase the compensation available.
Coverage includes:
- Medical Expenses: Upfront and ongoing treatment costs, including surgery, hospitalization, and continuing physical therapy
- Temporary Disability Benefits: Two-thirds of your average weekly earnings, up to the annual statutory maximum, while you’re unable to work during recovery
- Permanent Disability Benefits: Calculated on a scale of 0 to 100 percent based on your permanent loss of bodily function; permanent total disability may be paid for your lifetime

Personal Injury Claims & Additional Compensation Paths
When a third party’s negligence contributed to your injury, a personal injury claim can open up categories of compensation that workers’ compensation doesn’t cover. Workers’ comp is the exclusive remedy against your employer in most circumstances, so a personal injury case can’t typically be filed against them directly. However, third-party manufacturers, contractors, equipment distributors, or site operators may be liable.
Personal injury claims may allow recovery for:
- Psychiatric care beyond standard physical therapy coverage
- Lost future earning opportunities, interpreted more broadly than temporary disability wage replacement
- Pain and suffering damages not available under workers’ comp
- Loss of companionship and counsel in wrongful death cases
We also evaluate whether a client qualifies for the Subsequent Injuries Benefits Trust Fund (SIBTF). SIBTF provides additional benefits when a current industrial injury combines with a pre-existing disability to produce a greater level of total disability than the new injury alone would cause. For workers with prior injuries or conditions, this benefit may substantially increase the total compensation available. Workers whose injuries prevent them from returning to any employment may also qualify for Social Security Disability benefits, which we pursue alongside the workers’ compensation case.
