Ghitterman, Ghitterman & Feld Relentlessly Protecting California Workers' Rights Since 1956

California Social Security Disability Hearings Attorney

The promise of a safety net in the event of a disabling injury is a core part of the Social Security program. When an application for benefits is denied, that promise is placed at risk. Even more importantly, the applicant’s financial security and family are at risk. But there is recourse. Appeals can be filed. Our Social Security disability hearings lawyers have deep experience and a track record of success in helping people get the benefits they deserve.

Ghitterman, Ghitterman & Feld has served clients up and down the state of California for over 65 years. We’ve built a 95 percent success rate of recovering benefits for our clients. We offer free consultations and video conferencing for those who prefer this option of meeting. With a deep and talented legal team, we can help you prepare your case.

What To Expect at a Disability Hearing

When you file an appeal, an Administrative Law Judge (ALJ) will hear your case.

It’s important to know two things, both of which are different from conventional courtroom cases and both of which can give people peace of mind:

  • The disability hearing will be private. Testimony given does not go into the public record. If there is information that people prefer to keep private, the hearing will not place that at risk.
  • There is no opposing counsel attempting to “trick” or goad one into saying the wrong thing. The ALJ will ask questions, to be sure, and we’ll help prepare you. However, the sort of adversarial questioning that can be involved in criminal trials or civil lawsuits is not a part of disability hearings.

Common Evidence and Testimony Offered

Our California Social Security disability hearings attorneys will take the lead in helping you get the information needed to win your appeal. That starts with medical records and getting a report from the doctor.

It can also be helpful to request written testimony from family, friends, and perhaps one’s employer regarding how the disability has left you unable to work. The written testimony can be introduced for the ALJ.

Our clients can also bring in expert witnesses to testify in person. An example might be a physical therapist who is helping you recover and knows that returning to work is simply not an option.

It’s usually better to have reports and testimony be as detailed as possible. With our extensive experience in handling these types of cases, Ghitterman, Ghitterman & Feld can advise witnesses on what information should be included so that the ALJ can get a true understanding of our client’s condition.
