California applicants denied for insufficient medical evidence are sometimes sent to a consultative examination arranged by the state’s Disability Determination Services (DDS). That exam alone rarely resolves a denial. Building a complete, targeted medical record is what moves a claim forward.

The Four-Level SSA Appeals Process

Once you receive a denial, you have 60 days from receipt of the letter to file a written request for appeal. Missing that window generally means starting the application over from scratch, which delays benefits further and may affect your retroactive disability benefits eligibility. The SSA’s appeals process has four levels:

Reconsideration: A different SSA reviewer examines the claim and prior decision.

Federal district court: If the Appeals Council declines to act, you may file suit in federal court.

SSI vs. SSDI: What California Claimants Should Know

SSI and SSDI are both federal disability programs administered by the Social Security Administration, but they work differently. SSDI is funded by Social Security payroll taxes and is available to workers who have earned enough work credits over their career; benefit amounts are tied to earnings history. SSI, by contrast, is funded by general tax revenue and has no work history requirement. It’s available to aged, blind, or disabled individuals whose income and resources fall below program limits.

Some California claimants qualify for both programs at the same time, known as concurrent benefits. This typically applies when a person’s SSDI payment is low enough that their total income still falls below SSI thresholds. California also supplements the federal SSI payment through the State Supplementary Payment (SSP) program, which can increase the total monthly benefit above the federal base amount.

What a Successful SSI Appeal Can Recover

A favorable SSI or SSDI decision can mean ongoing monthly payments, retroactive payments tied to the established onset date of disability, and access to health coverage. Understanding what’s at stake is often what motivates claimants to see the appeals process through.

Retroactive SSI payments are generally limited to the month following the application date, while SSDI retroactive payments can extend up to 12 months before the application, depending on when disability is established. On the health coverage side, SSI recipients in California generally qualify for Medi-Cal immediately upon approval, while SSDI recipients typically become eligible for Medicare 24 months after their benefits begin. A denial doesn’t close the door on any of this.
