California Workers’ Compensation Benefits After Electrical Injuries
Workers’ compensation can cover reasonable medical treatment for a work-related electrical injury, provide partial wage replacement during recovery, and assist with returning to work. These benefits aren’t damages for pain and suffering or punitive damages.
Depending on the medical evidence and resulting limitations, available benefits may include:
- Medical care: Treatment for burns, neurological damage, cardiac complications, internal injuries, musculoskeletal trauma, and related conditions.
- Temporary disability: Partial wage replacement when medical restrictions prevent the worker from performing the usual job during recovery.
- Permanent disability: Benefits based on lasting impairment after the worker’s condition stabilizes.
- Supplemental job displacement: Assistance that may apply when permanent restrictions prevent a return to the former position and the employer doesn’t offer qualifying work.
- Treatment-related travel: Payment for reasonable transportation expenses connected to medical care.
- Death benefits: Benefits that eligible spouses, children, or other dependents may seek after a fatal workplace electrocution.
What to Do After an Electrical Injury at Work
Obtain emergency treatment when necessary and tell each medical provider that the incident happened at work. Cardiac, neurological, internal, and musculoskeletal effects can emerge or become clearer later, so feeling better shortly after electric shock isn’t a substitute for medical evaluation.
Report the injury to a supervisor as soon as possible. According to California’s Division of Workers’ Compensation, waiting more than 30 days to report a workplace injury may jeopardize benefits.
Preserve information that may document the incident and its effects:
- Medical records and work-status restrictions
- Wage records and missed-work information
- Incident reports and employer communications
- Photographs of injuries, equipment, and the work area
- Names and contact information for witnesses
- Insurance notices and claim correspondence
Our attorneys can organize this evidence, address disputed benefits, and investigate whether the hazard involved power-line contact, energized equipment, damaged wiring, inadequate grounding, or missing ground-fault protection.
When Someone Other Than an Employer May Be Responsible
Workers’ compensation addresses benefits arising from the employment relationship. A separate third-party claim may be possible when a person or company other than the employer contributed to the electrical hazard.
An investigation may focus on who made or maintained the equipment, controlled the worksite, or supplied utility service. Third-party claims involve legal standards, insurance policies, damages, and deadlines that differ from those governing workers’ compensation claims.
Early investigation can matter because equipment may be repaired, work areas may change, records can be lost, and witnesses may become unavailable. We examine potential third-party liability while the relevant evidence is still available.
