Issues in Employment Law
Some of the common legal disputes that arise on the job and that we help clients deal with include the following:
Workplace Safety
Employers are legally responsible for providing a safe and healthy work environment, free from hazards that could cause harm or injury. This includes implementing safety protocols, providing proper training, and maintaining equipment and infrastructure. Workplace safety is governed by federal law, regulatory agencies in the relevant industry, and the laws and regulations in California and the local municipality.
Discrimination
The 1964 Civil Rights Act prohibits anyone from being discriminated against based on race, religion, ethnicity, gender, or age. These are referred to as “protected characteristics.” Discrimination protection starts in the hiring process but includes what may or may not happen after a person begins a job. Promotions must be done equitably, and there must be equal pay for equivalent work. Companies are also prohibited from discriminating in more subtle ways, such as giving favorable shifts or working conditions to specific groups of people.
