In the workers’ compensation system, all workers, regardless of their immigration status, are entitled to receive workers’ compensation benefits. The workers’ compensation system is intended to help employees who are injured on the job to receive replacement wages (temporary disability), medical treatment, and permanent residual impairment compensation whenever an injury occurs on the job.

Documented work status (US citizen, Alien Residence, Work Permit, etc.) does not affect your right to receive workers’ compensation benefits. In fact, it is unlawful for an employer to retaliate against an injured worker because of their immigration status.
