Proving Your Accident Was Job-Related

To qualify for workers’ compensation benefits, the injured party need only establish that the incident occurred while doing their job. Who was at fault is irrelevant—that only matters in the case of a personal injury lawsuit. However, the injuries caused in a truck accident may still be subject to legal dispute. 

Consider the case of a driver in a minor accident where everyone walks away. But days later, their back and neck start to act up. The pain becomes debilitating enough that they can no longer drive. Do they get workers’ comp? 

Ideally, yes. However, there may be some dispute about whether the injury can be connected to the job. What if the plaintiff went and played recreational sports or undertook some other vigorous off-the-job physical activity in the days that followed the crash? The insurance carrier may argue that these actions—not covered by workers’ comp—are a more likely source of the back and neck problems. When the injured driver has pre-existing conditions with their back or neck, the actual cause of the injury can be subject to further dispute.
